Selling a Property
We appreciate that the process of selling your home can be stressful. We want to make the conveyancing process as stress free as we can, so you can enjoy the sale!
- We ensure your Contract of Sale or Section 32 is provided to your listing agent the same day that we are notified by either yourself or your real estate agent.
- If you are selling a property, we can help you with:
- Private Sales (Contracts & Section 32 statements)
- Auction Contracts
- If you are selling your property, we will:
- Ensure that your legal rights are protected and the transaction progresses to settlement without hassle
- Review all legal documentation and calculate financial adjustments (i.e. rates, water and body corporate levies etc.)
- Coordinate banks, solicitors and agents to ensure settlement occurs
- Ensure the effective release of mortgage/s with your lender/s
- Attend settlement on your behalf
- Forward proceeds by way of bank cheque or direct deposit to your nominated account
- Commit to keeping you informed on how your file is progressing
If you are selling a property and buying another, we can coordinate both contracts to ensure a smooth transition to your new property.
The Selling Process

| 1. Preparing Section 32's/Auctions Contracts |
|
- We order Title Search & relevant certificates
- Notify selling agent that we are acting for you
- Forward Section 32/Auctions Contracts to your agent
|
Provide our office with:-
- Your agents details
- Rate Notices
- Building Permits, Builders Insurance & Certificate of Occupancy – if applicable
- Provide Owners Corporation details – if applicable
- Provide us with details of your mortgage – if applicable

| 2. Once the property has been sold |
|
- We keep in close contact with the purchaser's solicitor and make sure that all conditions have been met (or arrange extensions)
- Notify Agent
- After conditions are met, your contract is now unconditional
- Send instructions to your mortgagee notifying them of the settlement date and request the title be available
|
- Contact Sargeants should you have any questions or should you wish to bring the settlement date forward
|

| 3. Lead Up to Settlement |
|
- Advise you of cost of additional searches if required
- Liaise with mortgagee to ensure they are prepared for settlement
- Receive settlement figures from purchaser's representative
- Book settlement with your mortgagee and purchaser's representative
|
- Receive correspondence from us and complete and sign Transfer documents and return to Sargeants Conveyancing
|

| 4. Just Prior to Settlement |
|
- Confirm settlement figures and settlement cheques with you. Cheque details are dependant on all parties involved
- This could be as late as the day of settlement
|
- After we advise you of the cheque details, you advise us of your bank account details
- This could be as late as the day of settlement
- Ensure the property is now vacant and left in a tidy manner for the new owner/s

| 5. Settlement |
|
- Attend settlement
- Send final letters to confirm details of settlement (to you and agent*)
|
- Receive final letter and Tax Invoice from Sargeants Conveyancing after settlement
|
|
| 6. Post Settlement |
|
- Send final letter to you with details of settlement figures and tax invoice for our account
|
